These Terms of Use (“Terms”) govern your use of the SMIL platform (smil.care), operated by Pencilixel Inc. By accessing or using SMIL, you agree to these Terms.
1. Who Can Use SMIL You must be 18+ or have legal guardian consent to use SMIL. PSWs must provide valid credentials to offer services through the platform.
2. Account Registration You agree to:
- Provide accurate and up-to-date information
- Keep your login credentials secure
- Accept responsibility for all activity under your account
3. Appropriate Use You agree not to:
- Misrepresent yourself or impersonate others
- Use SMIL for unlawful, abusive, or fraudulent activity
- Collect or misuse others’ personal data
4. Booking & Payments Families and PSWs are responsible for confirming bookings and payments. SMIL may charge a service fee for platform use. Payment processing is handled by secure third-party services.
5. Platform Changes & Availability We may modify or discontinue features without notice. We are not liable for outages, delays, or disruptions caused by third-party services or system updates.
6. Intellectual Property All platform content (text, design, branding) is the property of Pencilixel Creative Solutions Inc. You may not copy, modify, or distribute without permission.
7. Disclaimers & Liability We do not guarantee uninterrupted access or that services will meet every individual need. Users are responsible for verifying the credentials and compatibility of service providers or clients.
8. Termination We reserve the right to suspend or terminate accounts that violate these Terms.
9. Governing Law These Terms are governed by the laws of Ontario, Canada.
